Jim Knudsen and Kelly Magnus obtained summary judgment on behalf of a housing cooperative that sustained water damage after a pipe ruptured. Plaintiff performed fire inspection and maintenance on the dry sprinkler system at the cooperative. Plaintiff sought indemnification from the cooperative for damages caused by its own negligence based on indemnification and limitation of liability language included in the proposals/invoices. The Court held that the indemnification and limitation of liability clauses were void as a matter of public policy. The Court further held that the language of the exculpatory clauses was not clear and unequivocal.
